From the supplier: Paul Revere Corp rejected a total disability claim made by a dentist for HIV infection though his policy had been in effect over six years prior to his claim as it allegedly resulted from a pre-existing condition that should have been disclosed by the claimant, whose estate pursued the claim after his death in 1997. The Hawaii Supreme Court held that Revere was required to provide coverage where it had failed to clearly exclude specific causes of disability and there was no evidence of policyholder fraud in buying the policy. It also noted that Revere's policy was hopelessly ambiguous.
Citation DetailsTitle: Arguable manifestation of AIDS prior to inception of disability insufficient to permit recission because of both ambiguous policy language and state statutes regulating contestability. (disability insurance)
