American Sovereigns: The People and America's Constitutional Tradition Before the Civil War (Cambridge Studies on the American Constitution)
American Sovereigns is a path-breaking interpretation of America's political history and constitutionalism that explores how Americans struggled over the idea that the people would rule as the sovereign after the American Revolution. National and state debates about government action, law, and the people's political powers reveal how Americans sought to understand how a collective sovereign-the people-could both play the role as the ruler and yet be ruled by governments of their own choosing..

The Paradox of Constitutionalism: Constituent Power and Constitutional Form
The book sets out to examine some of the key features of what we describe as the paradox of constitutionalism: whether those who have the authority to make a constitution - the 'constituent power' - can do so without effectively surrendering that authority to the institutional sites of power 'constituted' by the constitutional form they enact. In particular, is the constituent power exhausted in the single constitutive act or does it retain a presence, acting as critical check on the constitutional operating system and/or an alternative source of authority to be invoked in moments of crisis? These questions have been debated both in different national contexts and at the level of constitutional theory, and these debates are acknowledged and developed in the first two sections of the book.

Part I includes chapters on how the question of constituent power has been treated in the constitutional histories of USA, France, UK and Germany, while Part II examines at the question of constituent power from the perspective of both liberal and non-liberal theories of the state and legal order. The essays in Part III consider the operation of constitutionalism with respect to a series of contemporary challenges to the state, including those from popular movements below the level of the state and challenges from the supranational and international levels, and they analyze how the puzzles associated with the question of constituent power are played out in these increasingly important settings..

Constituent Imagination: Militant Investigations, Collective Theorization

What is the relationship of radical theory to movements for social change? In a world where more and more global struggles are refusing vanguard parties and authoritarian practices, does the idea of the detached intellectual, observing events from on high, make sense anymore? In this powerful and unabashedly militant collection, over two dozen academic authors and engaged intellectuals-including Antonio Negri and Colectivo Situaciones-provide some challenging answers. In the process, they redefine the nature of intellectual practice itself.

The book opens with the editors' provocative history of the academy's inherent limitations and possibilities. The essays that follow cover a broad range: embedded intellectuals in increasingly corporatized universities, research projects in which factory workers and academics work side by side, revolutionary ethnographies of the global justice movement, and meditations on technology from the branches of a tree-sit in Scotland. What links them all is a collective and expansive re--imagining of engaged intellectual work in the service of social change. In a cultural climate where right-wing watchdog groups seem to have radical academics on the run, this unapologetic anthology is a breath of fresh air.
