From the supplier: A 5th Circuit Court of Appeals ruling that disallowed the Comptroller of Currency's Mar 21, 1990 decision to allow banks to sell fixed and variable annuities in cities with under 5,000 in population has caused confusion in both the insurance and banking industries. The decision was based on Section 92 of the National Bank Act, currently being litigated in numerous courts, which permits banks to sell insurance. The new ruling differs from other recent rulings and fails to interpret whether Section 92 means that bank insurance sales must be made in small towns only or can be made nationally from a small town headquarters.
