From the author: In the area of sexual harassment, state courts continue to map out new possibilities for recovery against employers. Due to the stress-related consequences of sexual harassment and the increase in stress claims under workers' compensation, employees are able to recover for disabling emotional or physical injuries. Also, courts have diminished the standard necessary to establish intentional infliction of emotional distress when sexual harassment is involved. Furthermore, many states have enacted their own civil rights statutes to create another avenue for claimants. Due to the different purposes of the various laws enacted to enable sexual harassment victims to receive damages, courts have begun to allow double recoveries. Claimants have been able to pursue workers' compensation and tort claims, workers' compensation and state civil rights claims, and workers' compensation and Title VII claims. Court decisions have even begun to hint at the possibility of a triple threat to employers in this area due to strong public policy concerns against allowing harassing behavior. In light of these trends, many managerial implications arise. For example, courts are inclined to find that an employer has ratified an employee or supervisor's harassing behavior. Courts are imputing liability unless employers can demonstrate that they took prompt and effective action to stop the harassment.
