From the supplier: Real estate managers need to be aware of the liability issues that usually crop up when participating in deals involving the buying and selling of property. There are at least four principal areas where the sale of a property can lead to liability for the real estate manager: misrepresentation by owner to the purchaser, selling the property too cheaply, faulty or delayed information that kills a deal, and misrepresentation to the purchaser. To minimize their risk of liability, managers should make sure that standard management contracts limit damages against the manager, include a disclaimer on reports to the owner, put a disclaimer on reports to the purchaser, and take extra precautions in property sales. They should also employ single-purpose entities for contracting purposes, and develop a sales assistance program for the owner.
