From the supplier: Very few clauses of the US Constitution can be characterized as stupid because deliberation preceded the inclusion of most clauses, but the "necessary and proper" clause of Article I does qualify as a constitutional stupidity. Review of the opinions of the Framers of the Constitution reveals that few understood why legislative powers should be limited by this clause. Constitutional scholars since that period have been unable to divine whether the clause even places any limits on Congress' powers.
